These Terms and Conditions ("Terms") govern your access to and use of the website clunqr.com and all related services (collectively, the "Services") operated by Junk Car Medics, LLC d/b/a Clunqr ("Clunqr," "we," "us," or "our"). Please read these Terms carefully before using our Services. By accessing or using our Services, submitting a quote request, or clicking any "I agree" or similar button, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use our Services.

1. Our Services

Clunqr operates an online platform that allows vehicle owners to request cash offers for their junk, salvage, or end-of-life vehicles. We connect you with a single vetted, licensed local buyer (a junkyard, salvage yard, or auto recycler) in our network who serves your geographic area. That buyer will evaluate your vehicle information, make you an offer, and — if accepted — coordinate pickup and payment. Clunqr acts as the intermediary facilitating this connection and transaction. We do not guarantee that an offer will be made for every vehicle submitted.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be the legal owner of the vehicle you are submitting, or be expressly authorized by the legal owner to sell it
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our Services under any applicable law

By submitting a quote request, you represent and warrant that you meet all of the above requirements. We reserve the right to refuse service to anyone for any reason at any time.

3. Quote Requests and Offers

All offers generated through our Services are subject to the following conditions:

  • Offers are based entirely on the information you provide, including vehicle year, make, model, trim, mileage, condition, title status, and location. The accuracy of your offer depends on the accuracy of your submission.
  • All offers are subject to physical verification at the time of pickup. If the vehicle's actual condition, title status, or other material details differ from what was submitted, the offer may be adjusted or withdrawn. You will be notified of any adjustment before the transaction is completed and are under no obligation to accept a revised offer.
  • Offers expire as communicated at the time of the offer. Expired offers are void and must be resubmitted.
  • We reserve the right to decline to make an offer on any vehicle for any reason, including but not limited to service area limitations, vehicle condition, or legal restrictions.
  • Submitting a quote request does not create a binding contract. A binding agreement is only formed when you affirmatively accept a specific offer and confirm a pickup appointment.

4. Vehicle Ownership and Title

You represent and warrant that:

  • You are the sole legal owner of the vehicle, or you have the express written authorization of the legal owner to sell it
  • The vehicle is not stolen, subject to an active police hold, or involved in an unresolved insurance claim that would prevent transfer
  • All information you provide about the vehicle's title status is accurate and complete
  • You will provide all documentation required to legally transfer ownership in your state (title, bill of sale, release of liability, or equivalent) at the time of pickup

If you are unable to provide proper ownership documentation at pickup, the transaction may be cancelled and no payment will be made. Misrepresenting vehicle ownership or title status may constitute fraud and could result in civil or criminal liability.

5. Pickup and Payment

Once you accept an offer and confirm a pickup appointment:

  • Our local buyer partner will arrive at the agreed location at the scheduled time to inspect and retrieve the vehicle
  • Payment is made at the time of pickup, typically in cash or by check, after the vehicle is verified and ownership documents are collected
  • Free towing is included with all accepted offers — you will not be charged for pickup or removal under any circumstances
  • You are responsible for ensuring the vehicle is accessible at the agreed location at the scheduled time
  • If you need to reschedule, please contact us as soon as possible. Repeated cancellations or no-shows may result in offer cancellation

Clunqr is not responsible for delays caused by circumstances beyond our or our buyer's reasonable control, including weather, traffic, equipment failure, or other force majeure events (see Section 13).

6. SMS Text Messaging Program

Program Name: Clunqr Vehicle Offer Notifications

Program Description: By submitting your phone number on our quote request form, you expressly consent to receive recurring SMS text messages from Clunqr related to your vehicle transaction. These messages may include offer details, offer updates, pickup scheduling, appointment reminders, follow-up communications, and customer support responses.

Message Frequency: Message frequency varies based on your transaction. You may receive up to 10 messages per vehicle quote submission.

Message and Data Rates: Message and data rates may apply depending on your mobile carrier and plan.

Consent Not Required: Your consent to receive SMS messages is not a condition of purchasing any goods or services from Clunqr. You may request a quote and complete a transaction without SMS by contacting us by phone or email.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. You will receive a single confirmation message confirming your opt-out. No further messages will be sent unless you initiate a new quote request.

Help: Reply HELP to any message or contact us at support@clunqr.com or (833) 637-6777 for assistance.

Supported Carriers: All major US carriers are supported, including AT&T, Verizon, T-Mobile, and others. Carrier message delivery is not guaranteed.

Data: Mobile opt-in data and consent will not be shared with or sold to any third party for marketing purposes.

7. Accuracy of Information

You agree to provide truthful, accurate, and complete information in all interactions with our Services. You acknowledge that any offer made by Clunqr or our buyer network is based on the information you provide, and that inaccurate or incomplete information may result in offer adjustment or cancellation at pickup with no payment obligation on our part. Knowingly providing false information — including misrepresenting vehicle ownership, title status, condition, or identity — is a violation of these Terms and may expose you to civil or criminal liability.

8. Prohibited Uses

You agree not to use our Services to:

  • Submit vehicles you do not own or are not authorized to sell
  • Submit stolen vehicles or vehicles subject to an active lien or legal hold
  • Provide false, misleading, or fraudulent information
  • Interfere with or disrupt the operation of our website or systems
  • Attempt to gain unauthorized access to any part of our Services or infrastructure
  • Scrape, harvest, or collect data from our website without our written consent
  • Use our Services for any unlawful purpose or in violation of any applicable law or regulation
  • Harass, threaten, or abuse our staff, buyers, or other users

We reserve the right to immediately terminate your access to our Services for any violation of this section.

9. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that a buyer will be available in your area, that an offer will be made for your vehicle, or that any specific offer amount will be achieved.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Clunqr, its parent company Junk Car Medics, LLC, and their respective officers, directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to lost profits, lost data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use our Services, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or our Services exceed the greater of (a) the amount of the accepted offer associated with your specific transaction, or (b) one hundred dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Clunqr, Junk Car Medics, LLC, and their respective officers, directors, employees, agents, buyers, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our Services; (b) your violation of these Terms; (c) your misrepresentation of vehicle ownership, title, or condition; (d) your violation of any applicable law or regulation; or (e) any dispute between you and a local buyer in our network.

12. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Monroe County, New York, or by telephone or video at your election.

Class Action Waiver: You and Clunqr each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or any other representative proceeding. All disputes must be brought in your individual capacity only.

Exceptions: Either party may bring an individual claim in small claims court. Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Informal Resolution First: Before initiating arbitration, you agree to contact us at support@clunqr.com and provide a written description of your dispute. We will attempt to resolve the issue within 30 days. If we cannot reach a resolution, either party may then proceed to arbitration.

13. Force Majeure

Clunqr shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, war, terrorism, civil unrest, government actions, pandemic, labor disputes, equipment or infrastructure failures, or interruption of utilities or communications services. We will make reasonable efforts to notify you of any such delay and to resume performance as soon as practicable.

14. Intellectual Property

All content on clunqr.com — including but not limited to text, graphics, logos, images, data compilations, and software — is the proprietary property of Junk Car Medics, LLC or its content suppliers and is protected by United States and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our Services without our prior written consent.

15. Third-Party Links and Services

Our website may contain links to third-party websites or integrate third-party services (such as payment processors or mapping services). These third parties operate independently and have their own privacy policies and terms. Clunqr is not responsible for the content, practices, or policies of any third-party website or service. Linking to a third-party site does not constitute an endorsement.

16. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the data practices described in the Privacy Policy.

17. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. For any matters not subject to arbitration under Section 12, you consent to the exclusive jurisdiction of the state and federal courts located in Monroe County, New York.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clunqr with respect to your use of our Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the same subject matter. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also notify you by email or by posting a notice on our website. Your continued use of our Services after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Services.
